By using our product and associated services, you agree to comply with and be bound by the following Terms and Conditions.

 

1. Use of the Product

1.1. Intended Use

INSPEC is intended for personal and research-based sleep tracking and lucid dreaming assistance. It is not a medical device and should not be used for diagnosing or treating sleep disorders.

1.2. User Responsibility

• You are responsible for using INSPEC in a safe and legal manner.

• Ensure the device is set up properly according to the provided instructions to avoid inaccurate readings.

 

2. Software and Data Usage

2.1 Licensing

INSPEC software, including any integrations with Lucid Scribe, is licensed, not sold. By using the software, you acknowledge that:

• You do not own the software but have a limited, non-exclusive right to use it.

• You may not redistribute, resell, or modify the software without prior consent.

2.2 Data Collection

• INSPEC collects and processes sleep-related data for functionality and research purposes.

• We do not have access to nor share personal data.

• Users may export or delete their collected data at any time through the associated software settings.

2.3 The Lucid Scribe apps

• The Lucid Scribe apps are free to use and are provided under the licence in section 2.1. Portions are open source, and where a component is published under an open source licence, that licence governs your use of it.

• Your dream journal is yours. lucidcode claims no ownership of anything you write, record or photograph in the apps, and does not receive it.

• Your entries are stored on your device. If you lose, reset or replace your phone without a backup, they are gone and cannot be recovered by us. Use Export Dream Journal, or connect Google Drive backup, and check occasionally that it is working.

• The apps connect to services operated by others, including Google Drive for backup, and are distributed through Google Play and the Apple App Store. Your use of those services is governed by their own terms and privacy policies, not these. We are not responsible for their availability, and a change on their side may affect features that depend on them.
   

3. Warranty and Liability

3.1 Limited Warranty

• INSPEC is provided "as is" without any guarantees regarding its accuracy or reliability.

• We warrant that the hardware is free from defects for 5 years under normal usage conditions.

• If a defect is found, we will replace or repair the device at our discretion.

3.2 Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use INSPEC.

• Users assume full responsibility for how they interpret and apply the data collected.

• Nothing in these terms excludes liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are unaffected.

4. Returns and Refunds

• Returns are accepted within 64 days of delivery and processed within 3 days. No questions asked.

• Shipping costs for returns are the responsibility of the customer unless the product is defective.

 

5. Compliance and Restrictions

• You may not use INSPEC for unlawful or unethical purposes.

• The device must not be used in ways that violate privacy laws or infringe on others’ rights.

6. Health and Safety

• Neither INSPEC nor the Lucid Scribe apps are medical devices, and nothing in them provides medical advice, diagnoses, treats or prevents any condition. If you have a sleep disorder, a psychiatric condition, epilepsy, or you are being treated for any health problem, speak to a doctor before using techniques that interrupt your sleep.

Some things deserve specific attention:

• Sleep interruption. Several techniques, including wake-back-to-bed, deliberately wake you during the night. Repeated sleep interruption can cause daytime tiredness and reduced alertness. Do not use these techniques when you need to be rested, and never drive or operate machinery while tired.

• Flashing light. REM light cues, whether produced by the INSPEC device or by the app, involve flashing or pulsing light. If you have photosensitive epilepsy or any history of seizures triggered by light, do not use these features.

• Sleep paralysis and vivid experiences. Lucid dreaming practice can bring on sleep paralysis, vivid dreams or distressing dream imagery. This is common and generally harmless, but if it disturbs you, stop and seek advice.

• Audio playback. Set volumes to a comfortable level before sleeping, particularly when using headphones.

• Physical setup. Position the device and any cabling so that it cannot fall onto or entangle a sleeping person.

You use these products and techniques at your own risk, and you are responsible for judging whether they are suitable for you.
 

7. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of INSPEC constitutes acceptance of the revised terms.

8. Governing Law

These Terms and Conditions are governed by the law of the Netherlands. If you are a consumer resident elsewhere in the European Union, you keep the protection of the mandatory consumer law of your own country.
